I. CALL TO ORDER – ROLL CALL: The meeting was called to order at 7:00 p.m. Board members present: Anthony Varda, Joe Kruchten, Jeff Davis and Duane Haag. Mike Statz was excused. Also present Clerk, Brenda Kahl.
II. APPROVE MINUTES OF FEBRUARY 20, 2017
Motion Haag/Kruchten to approve the minutes of February 20, 2017. Motion carried. Vote 4-0
III. PUBLIC COMMENTS: You may address the Board on any item not on the agenda. A discussion item may be placed on a future agenda. Public comment may be heard on any agenda item either now, or at the time the agenda item is to be discussed, or at the discretion of the Town Chair at any other time the agenda item is discussed.
*Sue Studz commented about State Assembly Bill 109 which amends Act 178, urged the town board to consider not opting out of Dane County zoning, and also questioned how the appeals function will be handled if the town opts out.
*Jim Pulvermacher, Dane County Towns Association Executive Board Representative, commented about State Assembly Bill 109, informed the board that the annual DCTA meeting is in April, and commented about a letter received from DATCP re farmland preservation zoning
*Phil Richards asked if a letter was mailed re Meier Road and commented on a property line fence situation
*Bert Bitter commented about opting out of Dane County zoning, prefers that the town stay with Dane County zoning, and commented on an article in the March newsletter
*Christine Molling commented about upcoming road work on Old Settlers Road
*Kevin Kahl commented that the town board represents the residents and are best to make decisions to opt out of Dane County zoning with public approval
IV. DISCUSSION/ACTION RE: 2016 AUDIT
Motion Varda/Davis to accept the 2016 audit. Motion carried. Vote 4-0
V. DISCUSSION/ACTION RE: CROSS PLAINS/BERRY FIRE DISTRICT AGREEMENT
Motion Davis/Kruchten to approve the current Cross Plains/Berry Fire District Agreement and at future fire board meetings we pursue any amendments we wish to try to resolve and negotiate with the fire district. Motion is lost. Vote 2-2. In favor: Davis and Kruchten Opposed: Varda and Haag
VI. DISCUSSION/ACTION RE: CYCLE ROAD EVENT PERMIT FOR CAPITOL VIEW EVENTS-CAPITOL VIEW TRIATHLON ON MAY 21, 2017
Motion Davis/Kruchten to approve the Cycle Road Event Permit for Capitol View Events-Capitol View Triathlon. Motion carried. Vote 4-0
VII. DISCUSSION/ACTION RE: RETAINING MSA ENGINEER FOR LIMITED PROJECTS AND/OR RECONSIDER TOWN’S ENGINEER
Motion Varda/Kruchten to retain MSA Engineers for the Scherbel Road project. Motion carried. Vote 4-0
Motion Kruchten/Davis to retain Jewell Associates Engineer for Turkey Road. Motion carried. Vote 4-0
VIII. DISCUSSION/ACTION RE: OPEN BOOK AND BOARD OF REVIEW DATES
Motion Varda/Haag to approve Open Book on May 1, 2017 from 4 – 6 pm and Board of Review on May 18, 2017 from 6 – 8 pm. Motion carried. Vote 4-0
IX. DISCUSSION/ACTION RE: ORDINANCE AMENDMENT 83, Amending Chapter 10 of the Dane County Code of Ordinances, authorizing Electronic Signs in the A-1Ex Exclusive
Motion Davis/Haag to disapprove Ordinance Amendment 83, Amending Chapter 10 of the Dane County Code of Ordinances, authorizing Electronic Signs in the A-1Ex Exclusive Agricultural District. Motion carried. Vote 3-1. In favor: Davis, Varda and Haag Opposed: Kruchten

A. Payment of bills
Motion Varda/Kruchten to approve the payment of bills. Motion carried. Vote 4-0
B. Purchase tires for 2012 Dodge truck, updated prices
Motion Haag/Kruchten to purchase four new tires from McFarlane at a cost of $280.95 per tire. Motion is lost. Vote 2-2. In favor: Haag and Kruchten Opposed: Varda and Davis
Motion Varda/Kruchten to purchase six tires from McFarlane at a cost of $280.95 per tire. Motion is lost. Vote 2-2. In favor: Kruchten and Varda Opposed: Davis and Haag
Motion Varda/Davis to reconsider buying four new tires from McFarlane at a cost of $280.95 per tire. Motion carried. Vote 4-0.
XII. COMMITTEE REPORTS/CORRESPONDENCE/COMMUNICATIONS
*Cross Plains Fire District: Two firefighters retired; created a list of their equipment which includes the estimated replacement year and cost
*Black Earth Fire District: Purchased a new ATV for $28,000 with $10,000 from a DNR grant; purchasing a new fire truck for around $650,000 - $680,000, Berry’s share is around 17%
*District 1 EMS: Director, Jim Wick, received an award for valuable service
*Roads Committee: Have a preliminary list of projects with estimated costs
*Highway Superintendent: Issue with TDS hitting a residents water line on Kahl Road
*Dane County Hazard Mitigation Meeting: Public input hearing on March 30 at the library in Cross Plains on the final draft
*Theis Road: April site visit to review a culvert that is in the town right-of-way
